Terms and Conditions for Using the ForSur Solar Customer Portal

1. Introduction
Welcome to the ForSur Solar Customer Portal (the “Portal”). By accessing or using the Portal, you agree to these Terms and Conditions (“Terms”). These Terms govern your access to and use of the Portal, including the collection, use, and processing of data from your inverter system portal via our API.
If you do not agree with these Terms, you must refrain from accessing or using the Portal.
2. Access to the Portal
2.1. Eligibility
You must be the authorized owner or representative of a solar inverter system connected to ForSur Solar to use the Portal.
2.2. Account Responsibility
You are responsible for maintaining the confidentiality of your Portal login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.
3. Data Access Authorization
3.1. Customer Consent
By using the Portal, you expressly grant ForSur Solar the right to access your inverter portal data, including but not limited to system performance and operational metrics.
3.2. Data Collection
ForSur Solar will use an API to securely retrieve and process your inverter data to provide you with insights, reports, and services related to your solar system.
3.3. Data Use
The collected data will be used solely to provide services to you, improve system performance, and ensure the effective operation of your solar inverter system. ForSur Solar will handle your data in accordance with its Privacy Policy.
4. Prohibited Activities
4.1. Automated Data Retrieval
You agree not to use any automated systems, bots, or scripts to access or retrieve data from the Portal. This prohibition is essential to ensure compliance with third-party agreements, including SMA Solar Technology AG’s (“SMA”) terms and conditions.
4.2. Unauthorized Access
You may not:
- Attempt to gain unauthorized access to the Portal or its systems.
- Interfere with the operation of the Portal.
- Misuse any data retrieved from the Portal.
5. Termination and Suspension
5.1. Breach of Terms
ForSur Solar reserves the right to terminate or suspend your access to the Portal if you breach these Terms.
5.2. End of Services
Upon termination of your Portal access, ForSur Solar will no longer retrieve data from your inverter system.
6. Liability and Indemnity
6.1. Limitation of Liability
ForSur Solar is not responsible for any issues arising from third-party systems, including inverter portals, or any damages resulting from unauthorized use of the Portal.
6.2. Indemnification
You agree to indemnify and hold ForSur Solar harmless from any claims, damages, or losses arising from your use of the Portal or breach of these Terms.
7. Intellectual Property
All content on the Portal, including but not limited to text, images, logos, and software, is the property of ForSur Solar or its licensors and is protected by copyright and trademark laws.
8. Changes to Terms
ForSur Solar may update these Terms from time to time. Updates will be posted on the Portal, and continued use of the Portal constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of The Netherlands. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Utrecht, the Netherlands.
